Section 1. House Rules

1.1 Members, their relatives and their guests are expected to act with proper decorum at all times when using Club facilities. Members are responsible and will be held accountable for the behavior of their relatives and guests and shall insure their compliance with all rules of the Club.

1.2 Members are specifically responsible for the behavior of their children or relatives and resident grandchildren using the facilities as provided in Section 4.6. Serious or persistent infractions of rules or improper behavior shall be reported to the committee chairman in whose area the problems occur, and by that chairman, in writing, to the House Committee Chairman. The House Committee or its chairman shall then meet with the member regarding the child's behavior and shall take action appropriate to the situation, which may include suspension of the member and member's family from the use of all Club facilities for a period not exceeding the balance of the season.

1.3 Appropriate Dress:

Henderson Dining Room: After 1800 hours, the dress code in the Henderson Dining Room and the living room is "Yacht Club Casual". Jackets and ties are welcome, but not required. Gentlemen must wear a button-down shirt, slacks and appropriate footwear. Shorts and jeans are not allowed in the Henderson Dining Room. At times, events held in the Henderson Dining Room will require men to wear a jacket and tie. The dress code for such events will be clearly stated.

Barker Clubroom: Yacht Club casual attire: button down shirts and slacks required. Shorts and jeans are not permitted.

Samoset Porch: Casual but neat - Members are welcome on the porch, especially after racing or tennis, or to meet for an impromptu dinner. Members and their guests should dress knowing that the porch offers an informal dining experience; casual, but neat clothing is appropriate and in keeping within the spirit of the Porch and the Club. Jeans are permitted. Ripped clothing and swimwear are not appropriate.

General:

a.     Hats, including Service Dress, shall not be worn within the Clubhouse or Barker Club Room at any time. Members and guests may wear hats in the informal areas of the Club's porches, with the exception of the Samoset Porch dining area during lunch and dinner hours.

b.    Except in the Galley Grille, the wearing of bathing suits is not permitted in the Clubhouse at any time.

c.     Footwear must be worn in the Clubhouse at all times.

1.4 The Chairman, members of the House Committee and the Club Manager are authorized to enforce these rules and to report such violations to the full House Committee.

1.5 Except on evenings when there are special events, the Clubhouse will be open weekdays from 0800 until 2230 hours and on weekends until 2300 hours, after which admittance will be granted only to those occupying bedrooms.

1.6 Bedrooms may be engaged by members, and may, by arrangement with the Club Manager, be occupied by guests of a member introduced in the manner set forth in Section 4.4 of these rules.

1.7 The bulletin board opposite the main desk is designated as the official Club bulletin board on which racing results, postings of the Committee on Admissions, House Committee announcements, and other information for the entire Club shall be displayed. Bulletin boards at the waterfront, pool, and tennis courts are intended for use by their respective committees. No notice shall be posted elsewhere in the Clubhouse or on the grounds without permission of the House Committee.

1.8 It is requested that dogs not be brought onto Club property.

1.9 No member or guest shall borrow, take, or cause to be taken any property of the Club, unless specific permission to do so has been granted by the Club Manager or House Committee. Any person who shall take from the Club any property whatsoever shall be obligated to return same as agreed, and if damaged, defaced, lost or destroyed, shall pay the cost of repair or replacement, unless excused from such obligation by the House Committee.

1.10 No employee of the Club shall serve alcoholic beverages to persons under the age of 21, nor shall they serve alcoholic beverages to persons who appear to be intoxicated.

1.11 The Club will publish a "cancel by" date for each event for the coming season. The "cancel by" date will be communicated at the time a reservation is made. Cancellations made after the published date or no-shows will result in the full cost of the event billed to the member's account.

1.12 No one under the age of 18 years shall be permitted in the Barker Club Room and the Bar except on evenings when the informal dining is moved, due to inclement weather, from the Samoset Porch into the Barker Club Room or on such other special occasions as may be prescribed by the House Committee or the Manager of the Club.

1.13 Cellular Telephone use is limited to the area near the front desk where other telephones are installed. Those using cellular telephones in other areas of the Clubhouse, including the porches, will be asked to move to this telephone area to continue their calls.

Section 2. Dining and Reservations

2.1 Reservations are required for the dining room and are suggested for the informal dining areas. They should be made as far in advance as possible. Reservations should be made for the time the party desires to be seated, not the time expected for arrival at the Club. If one is unable to keep a dinner reservation, it must be cancelled prior to 1700 hours, or a charge of $5.00 per person reserved will be assessed.

2.3 Except on special occasions when operating hours are extended by order of the House Committee, parties must be seated so that dining room dinner orders are placed prior to 2100 hours, and informal dining orders are placed by 2045 hours.

2.4 Members and guests are expected to arrive in advance of their reservation time, notify the dining room or informal dining room area staff of their arrival and expected whereabouts within the Clubhouse, and to be seated promptly when their table is called. Parties not available when their table is ready may forfeit their reservations and may not be able to be accommodated that evening.

Section 3. Employees of the Club

3.1 Article VI, Section 5 of the By-Laws prohibits the giving of gratuities by any member or guest to any employee of the Club. The House Committee insists upon observance of this By-Law by employees of the Club as well.

3.2 No member or guest shall reprimand, abuse, or interfere with the duties of any employee of the Club. Any complaint regarding an employee should be directed in writing to the House Committee or the chairman of the committee for whom the employee works.

3.3 No employee of the Club shall be sent off Club premises except on the authority of the Club Manager or appropriate department manager.

Section 4. Use of the Club by Non-Members

4.1 For fees as set from time to time by the Finance Committee, any member wishing to extend to a non-member the privilege of using the Club must first obtain from the main desk a card of invitation signed by the House Committee Chairman, by either presenting a letter of introduction on behalf of the non-member, or by personally making an entry in the visitor's book which is maintained at the main desk for such purpose. The House Committee Chair shall have the discretion to determine whether the foregoing privilege is to be extended in any particular case.  Such privilege shall be for the exclusive use of the guest so introduced and the guest's immediate family, shall be limited as to any individual to one period not exceeding 10 days in any season of operation and unless otherwise determined by the House Committee Chair may not be extended to any individual for two years in a row. Such privilege may not be extended to any person rejected for admission to the Club by the Committee on Admissions within two years or to any person who has previously been a member of the Club and who would not meet the Non-Resident Member qualifications.  No member shall receive direct or indirect compensation (whether in the form of cash, rental income or otherwise) for extending the privileges referred to in this Section 4.1.  Except as provided below, this Section 4.1 shall be the only method by which use of the Club and its facilities may be extended to non-members.

4.2  When accompanied by a member, a guest may use the pool, tennis or paddle tennis courts, but not for more than one day in any two-week period.  Members must enter their guests using the pool or tennis or paddle tennis courts pursuant to this Section 4.2 in the guest book maintained for such purposes and in the visitor's book at the main desk if otherwise appropriate.

4.3 A non-member may also use the Club as follows: 

       4.3.1 A non-member may use the waterfront facilities when such person is a guest on a member's yacht lying in the harbor.

       4.3.2 A non-member accompanied by a member may be a guest for dinner or drinks at the Club.

       4.3.3. A non-member may be a guest in a scheduled yachting event or tennis or paddle tennis tournament and use the facilities of the Club related to that event.

4.4 Bedrooms may be engaged by members and occupied by their guests for not more than three consecutive nights, unless a longer period is permitted by the House Committee. Occupants of these rooms may use the clubhouse and pool facilities while staying at the Club whether accompanied by a member or not. Notice of intention to vacate a room must be given at the office before 1100 hours and the room should be vacated by 1300 hours, or another night's rental will be charged.  The privileges established in this Section 4.4 are subject to the rules of the use of the Clubhouse and pool applicable guest charges in effect from time to time.

4.5 The spouse (or in the case of an unmarried member, an escorted date) and unmarried children under 21 of a member shall be entitled to use the waterfront, Clubhouse, pool, tennis and paddle tennis courts in accordance with the rules for such use in effect from time to time and without payment of guest charges. No charge shall be made for the use of the pool by a babysitter while actually supervising the minor children of a member.

4.6 The grandchild or other relative of a member shall be permitted to use the facilities of the Club as would a member's child under 21, provided that the member seeks and obtains approval of the House Committee, and pays a fee as set forth from time to time by the Finance Committee for each such relative; and also provided, unless otherwise permitted by the House Committee, that said relative is (1) unmarried, (2) under 21 years of age, (3) part of the member's household for at least three weeks of the season, and (4) not accompanied by parents while visiting the member.

4.7  The child of a member who is 21 or older but who has not reached his/her 25th birthday as of May 1, shall be permitted to use the facilities of the Club as would a member's child under 21, provided that the member seeks and obtains approval of the House Committee and pays a fee as set forth from time to time by the Finance Committee for each such child; and also provided, unless otherwise permitted by the House Committee, that (1) such child is unmarried, and (2) such child resides in the member's home for the summer. A child given these privileges shall be given a guest card for the Club season.

4.8 Upon the application to the House Committee by a sponsoring member, the House Committee may extend the privileges of the Club (including the use of the waterfront, dry storage area, Clubhouse, pool and tennis and paddle tennis courts in accordance with the rules for such use) for up to one Club summer season to one or more non-member competitive sailors of widely recognized international standing whose permanent residence is located more than 75 statute miles from the Clubhouse who desire to compete, and shall compete, in one or more yacht racing events or series in Marblehead waters; provided that the granting of such privileges shall in each instance be subject to the approval of the Council; and provided further that each person accorded such privileges shall pay a fee to be fixed in each instance by the Finance Committee, which fee shall not exceed the amount of the Club dues for one year for a regular member 35 years of age or older as set forth in the By-Laws of the Club. Such privileges shall not be granted to any person for more than one summer season.

4.9 In each case of usage of the Club by non-members as provided in Section 4, the member sponsoring, introducing or accompanying the non-member is responsible for the behavior, compliance with rules, and any charges incurred by the non-member, as further detailed in Sections 1.1, 1.2 and 5.2 of these rules.

4.10 The children of a member who are 21 years of age or older, or relatives of a member not covered by Section 4.6 or Section 4.7 of these rules, are not entitled to use the facilities of the Club unless such children or relatives are admitted to membership in accordance with the By-Laws of the Club or unless such use is made pursuant to Section 4.1, 4.2 or Section 4.5 of these rules.

4.11 As provided by Article V, Section 2 of the By-Laws, non-members who are on board yachts visiting Eastern waters, and are admitted by the Commodore or House Committee Chairman to the privileges of the Club, and non-members who are members of Reciprocal Yacht Clubs shall be guests of the Club itself, rather than of an individual member. Such guests shall obtain a "Visiting Yachtsmen Registration Form" at the main desk in the Clubhouse, and will be issued a special registration card which they must present whenever obtaining services from the Club. In consideration of the broad usage by Club members of the facilities of other yacht clubs, no guest fees for use of the pool or tennis facilities will be charged to such visitors.  "Reciprocal Yacht Clubs" shall be those yacht clubs designated as such from time to time by the Council, a list of which shall be kept at the main desk in the Clubhouse.

4.12 Should the behavior of a guest using Club facilities as provided herein be reported to and considered improper by the House Committee, said guest may be immediately excluded from the use of all Club facilities. At its discretion, the House Committee may request the sponsoring member to refrain from introducing further guests for the balance of the season.

Section 5. House, Dues, and Assessment Charges

5.1 Members whose bills remain unpaid at the end of the monthly billing period following the monthly billing period for which the bill was rendered will be subject to a monthly interest charge of 1.5% per month, compounded monthly, of the overdue amount (with a minimum charge of $2.00), or the maximum amount allowed by applicable law if less. Members whose bills remain unpaid at the end of the second monthly billing period following the monthly billing period for which the bill was rendered will have their credit privileges suspended until such time as all bills previously rendered and the bill rendered for such second monthly billing period have been paid in full. In order to avoid hardship in any particular individual's case, this rule may be modified in specific circumstances by application to the Treasurer.

5.2 Members shall be responsible for charges incurred by their guests or relatives. If a bill rendered a guest remains unpaid after 30 days, the charge will be transferred to the member's account.

5.3 For each season, the House Committee will establish a minimum charge applicable to dining room usage only, for each member, except as set forth below. Each member will be billed the full minimum charge at the beginning of the season. Should a member's dining room charges be more than the minimum at any time during the season, these excess charges will be billed to that member at the close of that billing period. The following members shall be exempt from the minimum charges under this Section 5.3: (i) Non Resident Members; (ii) Honorary Members; (iii) every other member who would satisfy the standards for Non-Resident Member status under Article II, Section 9 of the By-Laws, except for the fact that the member's legal residence and place of abode are 50 or more miles, but less than 75 miles, from the Clubhouse; and (iv) members described in Section 1 (d) of Article III of the By-Laws.
