Section 1.0 General Provisions and Safety
1.1 The EYC provides a comprehensive Waterfront Facility to its Membership which includes, but is not limited to; Launch Service within the confines of Marblehead Harbor, Cranes, Floats, Dry Sail Storage, Winter Storage, and various other storage facilities. These services are available as a convenience to EYC Members and their Guests who may use them at their sole risk.
1.2 The Dockmaster is designated to be in charge of the EYC Waterfront Facilities and is responsible under the supervision of the Waterfront Committee for its administration, safety and general good order. The Dockmaster is responsible to see that all Coast Guard and other regulations pertaining to the Waterfront Facilities are observed. In the absence of the Dockmaster, the Assistant Dockmaster shall assume these responsibilities.
1.3 The Chairman and Members of the Waterfront Committee, the Dockmaster, Assistant Dockmaster and the General Manager, are authorized to bring these rules to the attention of those who violate them and to report such violations to the Council.
1.4 Infractions of rules or improper behavior by a Member, a Member's guest or a Member's child on the Waterfront should be reported to the Waterfront Committee. The Waterfront Chairman, or his designee, will then meet with the Member regarding the infraction to determine the appropriate course of action which may include, but is not limited to, the suspension of use of the Waterfront facilities.
Section 2.0 Acceptable Maintenance Practices
2.1 Due to stringent environmental statutes and regulations, the EYC can be exposed to penalties as a result of improper waste disposal. Therefore, disposal of waste motor oil, transmission and hydraulic fluids, and any other toxic fluids and materials on EYC premises is strictly prohibited. Disposal of such fluids and materials is the responsibility of each Member, and no such fluids and materials may be left or disposed of on EYC property.
2.2 The storage or disposal of any flammable materials on EYC property is strictly prohibited.
2.3 The use of pressure washers for any purpose is strictly prohibited anywhere on EYC property.
2.4 Wet sanding or cleaning a bottom while the boat is hanging on the cranes is prohibited.
2.5 Dry sanding with dustless sanders, wet sanding (other than the crane area), scraping and the use of paint strippers on anti-fouling paint is permitted on EYC property provided drop cloths and/or tarpaulins are used to collect any and all waste material. The disposal of waste material is the responsibility of the Member and disposal on EYC property is strictly prohibited.
2.6 Member's are allowed to hire third party contractors to perform work on their vessel while being stored on EYC property. Prior to work commencing the Member must inform the Dockmaster that a contractor will be on EYC property performing work on their vessel. Prior to work commencing the contractor must file with the Dockmaster a Certificate of Insurance proving liability insurance in an amount not less than $1,000,000.00 which includes full worker's compensation coverage.
2.7 It is the responsibility of the Member, not the Waterfront Staff, to ensure that contractors performing work on their vessel adhere to the EYC Acceptable Maintenance Practices.
2.8 Any questions referring to Acceptable Maintenance Practices should be directed to the Dockmaster. If a specific maintenance practice is not referenced herein it should be assumed not to be permitted until specific permission is provided by the Dockmaster. dockmaster@easternyc.org.
2.9 Failure of a Member or a Member's contractor to comply with the aforementioned regulations can, at the election of the Waterfront Committee, result in loss of storage privileges.
Section 3.0 Winter Storage
3.1 Winter Storage is made available by the EYC as a privilege and convenience to the Members and the EYC does not assume any responsibility for fire, theft, vandalism, storm damage or any other loss or damage.
3.2 Winter Storage permits are issued at the discretion of the Dockmaster and Waterfront Committee. Winter Storage fees are established by the Waterfront Committee and subject to change without notice.
3.3 Winter Storage is available during the period October 1st through May 15th. Any winter storage vessel that remains in the Winter Storage Area after May 15th is subject to a $25.00 per day penalty until the vessel is removed. It is the Member's obligation to communicate in writing with the Dockmaster if due to unforeseen circumstances they are unable to meet the May 15th deadline. dockmaster@easternyc.org.
3.4 During the period October 1st through May 15th only vessels with winter storage permits or those with written permission granted on a short term basis by the Dockmaster are permitted in the Winter Storage Area.
3.5 Prior to October 1st the Member must inform the Dockmaster of their intention to utilize the EYC Winter Storage privilege. dockmaster@easternyc.org. Prior to October 1st the Member must complete the Winter Storage Form which is available at the Front Desk and on the EYC website, www.easternyc.org. In addition to the Winter Storage Form the Member must also provide a current Certificate of Insurance that proves liability coverage of not less than $500,000. The Winter Storage Form and Certificate of Insurance must be provided to the Dockmaster on an annual basis.
3.6 Members will be assigned a Winter Storage space by the Dockmaster which is where the vessel will remain while being stored on EYC property during the winter season. The Member is responsible for regularly checking the condition of the cover, jack stands, cradle or trailer to ensure they are secured properly and in good operating condition. The Member is also responsible for keeping the area assigned to them in a neat and orderly condition.
3.7 Winter Storage is available to vessels with an LOA of not more than 30 feet. Jack standed vessels are prohibited from winter storage. Winter Storage vessels that were stored on jack stands prior to the winter of 2005 are "grandfathered." The Waterfront Committee reserves the right to make exceptions to this provision on a case by case basis.
3.8 Flammable materials may not be stored in storage boxes or in the vessels.
3.9 No vessel shall be stored with its mast(s) stepped.
3.10 Winter covers must be removed by May 15th.
3.11 Trailers must be clearly marked with the Member's name and have a license plate with current registration sticker.
3.12 Failure to comply with the Winter Storage provisions may result in removal of the boat from the premises at the risk and expense of the Member and can, at the election of the Waterfront Committee, result in loss of storage privileges.
Section 4.0 Dry Sail Storage
4.1 Dry Sail Storage is provided by the EYC as a privilege and convenience to the Member and the EYC does not assume any responsibility for fire, theft, vandalism, storm damage or any other loss or damage.
4.2 The Dry Sail Storage area is designated solely for the use of EYC Members and their Guests. Dry Sail Storage is intended for actively used sailing and power vessels. The Waterfront Committee, in its sole discretion, will determine whether a vessel is being actively used. In the event that Dry Sail Storage becomes over subscribed, priority will be given to those sailing vessels that are actively competing in MRA and other like kind events. The Dry Sail Storage area may also be used for special regattas but only with prior written approval of the Waterfront Committee.
4.3 Dry Sail Storage permits are issued at the discretion of the Dockmaster and Waterfront Committee. Dry Sail Storage fees are established by the Waterfront Committee and subject to change without notice.
4.4 Dry Sail Storage is available during the period May 16th through September 30th.
4.5 Prior to May 16th the Member must inform the Dockmaster of their intention to utilize the Club's Dry Sail Storage privilege. Prior to May 16th the Member must complete the Dry Sail Storage Form which is available at the Front Desk and on the EYC website, www.easternyc.org. In addition to the Winter Storage Form the Member must also provide a current Certificate of Insurance that proves liability coverage of not less than $500,000. The Dry Sail Storage Form and Certificate of Insurance must be provided to the Dockmaster on an annual basis.
4.6 During the period May 16th through September 30th only vessels with Dry Sail Storage permits or those with written permission granted on a short term basis by the Dockmaster are permitted in the Dry Sail Storage area.
4.7 Members will be assigned a Dry Sail Storage space by the Dockmaster which is where the vessel will remain while being stored on EYC property during the summer season. The Member is responsible for regularly checking the condition of the trailer to ensure that it is in good operating condition. The Member will also ensure that wheels are properly chocked and that the area assigned to them is kept in a neat and orderly condition. No material, sails, dinghies or other gear may be stored on the ground or on the trailer. All such equipment must be stored either in the vessel or in gear boxes permanently affixed to trailers.
4.8 Flammable materials may not be stored in storage boxes or in the vessels.
4.9 Any vessel left in the Dry Sail Storage area without permission from the Dockmaster, or left in a space other than the space it has been assigned, may be removed and stored at the owner's risk and expense.
4.10 Trailers must be clearly marked with the Member's name and have a license plate with current registration sticker.
4.11 Empty trailers that do not have a Dry Sail Storage permit may not to be left in the Dry Sail Storage area without specific consent from the Dockmaster.
4.12 All trailers must be equipped with an operating tongue jack with wheel and safety chains. While under tow on EYC property the safety chains must be affixed to the towing vehicle.
4.13 Vehicles may not be parked unattended in the Dry Sail Storage area. Unattended vehicles, whether attached to a trailer or not may be removed and stored at the owner's risk and expense.
4.14 Failure to comply with the Dry Sail Storage provisions may result in removal of the boat from the premises at the risk and expense of the Member and can, at the election of the Waterfront Committee, result in loss of storage privileges
Section 5.0 Additional Services & Waitlists
5.1 The EYC Waterfront has Additional Services for seasonal rental which include dinghy tie-up rings, dinghy storage on the EYC SW Floats, dinghy storage on the EYC NE Floats, inner and outer trawl moorings, storage lockers on the EYC Pier, storage lockers located underneath the Clubhouse and kayak storage racks located in the Dry Sail Storage area.
5.2 Permits for Additional Services are issued at the discretion of the Dockmaster and Waterfront Committee. Fees for these services are established by the Waterfront Committee and subject to change without notice.
5.3 Pending Member demand at any given time there may or may not be a waitlist for any of the Additional Services. Each Additional Service is separate and distinct. Specific requests must be made in writing to be added to each Additional Service that has a waitlist. Member position on a specific Additional Service waitlist is determined by the date that written notification is received by the Dockmaster and is not transferable to another Additional Service waitlist. dockmaster@easternyc.org.
5.4 It is the Member's obligation to maintain copies of all correspondence regarding the waitlists.
5.5 If a Member on a waitlist is offered a permit for an Additional Service and declines for any reason, their name will removed from the waitlist.
5.6 Persistent lack of use of any Additional Service permit, as determined by the Waterfront Committee, may result in the loss of that permit.
5.7 Upon obtaining a permit for an Additional Service the Member will be assigned a number correlating to a specific tie-up ring, trawl mooring, storage space or locker. The Member will ensure that that area assigned to them is kept in a neat and orderly condition.
5.8 Additional Service permits may not be transferred from Member to Member. A Member's position on a waitlist is also not transferable.
5.9 Upon accepting an inner trawl mooring permit the Member acknowledges that launch service to inner trawl moorings is not available.
5.10 Flammable materials may not be stored in lockers. Gas hoses for outboard motors may be stored in the lockers located on the EYC Pier only.
5.11 Members may choose to secure their dinghy to the float with a lock but the combination or a spare key must be provided to the Dockmaster in the event the dinghy needs to be moved. If the combination or spare key is not provided the lock may be cut at the owner's expense.
5.12 Failure of a Member to comply with the Additional Services provisions can, at the election of the Waterfront Committee, result in loss of their Additional Service permit.
Section 6.0 Floats & Piers
6.1 The EYC Floats and Piers are provided as a privilege and convenience to EYC Members and Guests.
6.2 The use of the EYC Floats or Piers for swimming, fishing or for any commercial enterprise is strictly prohibited.
6.3 State Law requires that children age 12 and under must wear a personal flotation device while on the EYC Waterfront.
6.4 Unattended tie-up at any of the EYC Floats at any time is prohibited. The Dockmaster, in his sole discretion, will determine whether a boat has been left unattended.
6.5 For the consideration of fellow Members tie-up times are limited to 20 minutes for the purposes of loading, unloading and wash downs unless specific permission is granted by the Dockmaster.
6.6 The EYC Floats are identified as the EYC Main Float, EYC Launch Float, EYC Southwest Floats, EYC Rack Float, EYC Dinghy Float, EYC Crane Pier Main Float, EYC Crane Pier Northeast Floats, EYC Crane Pier Southwest Floats, and the EYC Crane Pier Finger Floats and are more fully described as follows:
6.6a The EYC Main Float is reserved as the gangway landing for the EYC Pier. The two dinghy tie-up spaces located underneath the gangway are reserved for the EYC dinghies only. Short term tie-up of smaller vessels is available on the Northeast and Southwest sides of this float.
6.6b The EYC Launch Float is reserved solely for the use of EYC launch service. Permission to use the float on a temporary basis may be granted by the Dockmaster for the purposes of boarding and disembarking passengers on large vessels.
6.6c The EYC Southwest Floats, on the beach side, have in-water ring tie-up spaces and out of water deck storage spaces for dinghies that do not exceed eleven feet in length. Please refer to Section 5.0 for information on obtaining a ring tie-up or deck storage space. The harbor side and end of the EYC Southwest Floats are available to larger vessels wishing to tie up in accordance with Sections 6.4 and 6.5.
6.6d The EYC Rack Float, on the beach side, has in-water ring tie-up spaces and out of water rack storage spaces for dinghies that do not exceed eleven feet in length. Please refer to Section 5.0 for information on obtaining a ring tie-up or deck storage space. The harbor side and end of the EYC Rack Float are available for larger vessels wishing to tie up in accordance with Sections 6.4 and 6.5. On race days the harbor side and end of this float are reserved for the tie-up of Race Committee vessels.
6.6e The EYC Dinghy Float is provided solely for the purpose of ring tie-up spaces for dinghies that do not exceed eleven feet in length. Please refer to section 5.0 for information on obtaining a ring tie-up space.
6.6f The Crane Pier Main Float is reserved as the gangway landing for the EYC Crane Pier. There are two dinghy tie-up spaces located underneath the gangway, one is reserved for the EYC Junior Sailing Program and one is reserved for Pleon Yacht Club. Short term tie-up of smaller vessels is available on the Northeast and Southwest sides of this float. During race days this float is reserved for racing vessels as they haul and launch their boats. During class times Members will defer tie-up spots on this float to the Pleon Yacht Club.
6.6g The EYC Crane Pier Northeast Floats are available for tie-up on the beach side and harbor side in accordance with Sections 6.4 and 6.5. During race days these floats are reserved for racing vessels as they haul and launch their boats. During class times Members will defer tie-up spots on these floats to the Pleon Yacht Club.
6.6h The EYC Crane Pier Southwest Floats are available for tie-up on the beach side and harbor side in accordance with Sections 6.4 and 6.5. During race days these floats are reserved for racing vessels as they haul and launch their boats. During class times Members will defer tie-up spots on these floats to the Pleon Yacht Club.
6.6i The EYC Crane Pier Finger Floats, which are affixed to the Crane Pier, are solely for the purpose of facilitating the hauling and launching of boats at the Cranes and Ramp.
6.7 Failure of a Member to comply with the proper use of the EYC Float provisions can, at the election of the Waterfront Committee, result in the suspension of Float privileges.
Section 7.0 Cranes
7.1 The EYC Cranes are provided as a privilege and convenience to EYC Members and shall be used at the Member's sole risk. If a Member is unfamiliar with the use or operation of the EYC Cranes he or she is strongly encouraged to seek assistance from the Dockmaster or Assistant Dockmaster.
7.2 The EYC Cranes are located on the Crane Pier and are owned and maintained by the EYC. The EYC Cranes are to be used solely by the Members of the EYC. The EYC Cranes may be used for special regattas hosted by the EYC but only with prior written approval of the Waterfront Committee.
7.3 The operator of an EYC Crane must be 18 years or older.
7.4 The EYC Cranes shall not be used for vessels weighing in excess of 7,500lbs.
7.5 During race days Members are asked to defer the use of the EYC Cranes to racing vessels as they haul and launch their boats.
